TERMS OF SERVICE

Welcome to campersAPP, owned by Gere Enterprises, LLC. (the “Company”).
By accessing the campersAPP mobile Application, the campersAPP website
(found at http://www.campersapp.com/), or the campersAPP builder dashboard,
you (the “User”) agree to be bound by these Terms of Service (TOS). If you do
not accept and agree to the Terms, including the Privacy Policy, please do not
use the Service.
Updates and Changes
campersAPP will evolve over time. Features may be available on a limited basis
and are subject to change without notice. We may, at any time, change or
amend these Terms (including modifying, deleting, and/or adding any portion
thereof). We recommend reviewing the TOS regularly to keep yourself apprised
of any updates or changes. Using the campersAPP service constitutes your
acceptance of the campersAPP terms and recent revisions.
Information collected automatically
When you (the “User”) uses the campersAPP mobile App or campersAPP
website, some information will be collected automatically which could include
your IP address, device ID and type, your devices’ geographic location as well as
your browser type. This information is used to provide analytics to campground
owners about app use and to enhance the camping experience.
Eligibility
The campersAPP Service is only available at Parks located within the US and
Canada. Services are directed to persons over the age of 13 and you (the
“User”) must be 13 years of age to use the Service. By accessing and using the
Service, you warrant that you have the authority to do so.
Access
General Login Keys:
Each Park on the campersAPP network is issued a General Login Key (GLK)
that will grant you (the “User”) access to Park information and policies, the Park
map, weather at the Park, daily Park activities, real-time Park alerts and
notifications, nearby attractions and services, outdoor trails, photo share, and
games (a.k.a. Camp Social). When logged in with a GLK, you (the “User”) will not
be asked to provide personal information. We will collect your device ID in order
to provide campgrounds with App usage analytics and we will utilize your mobile
device’s geographic location for the purpose of providing turn-by-turn directions
to nearby attractions, restaurants, services, stores, trails, and water recreation.
Your mobile device ID will not be shared with third parties.
Unique login Keys:
Certain features/functions on campersAPP are designed to enhance the
customer experience and require you (the “User”) to have a campersAPP
account. An account can be created by you (the “User”) or by the campersAPP
enabled Park you are visiting. The two features that require you (the “User”) to
have an account include the “Services Module” and the “Message a Camper”
feature. The “Services Module” allows you (the “User”) to request goods and
services in App and “Message a Camper” makes it possible for campers to
communicate with you (the “User”) by email or through text messaging. Not all
campgrounds on the campersAPP network offer these enhanced services. To
obtain a ULK, you (the “User”) will be asked to provide the following personal
information: your name, address, phone number, email address, campsite
number, and your dates of stay. Delivery Services will be active during your
reservation. If you have a campersAPP account and wish to opt out or cancel
your account, and have us delete your personal information, you can do so at
anytime by sending an email to support@campersapp.com.
In App Purchases
Some Parks on the campersAPP network will allow you (the “User”) the ability to
order and pay for services in App. Some examples may include the delivery of
firewood, ice, and propane (to your site). Campgrounds can process payments
for services requested in App in one of two ways:
1. Campgrounds can open a tab for their campers allowing their guests the
ability to purchase services on a tab. If you are not prompted to enter
financial information in App when placing an order, the campground you
are visiting is utilizing the tab system and payments will be processed
outside of campersAPP utilizing the campground’s point of sale system.
Although we will not collect financial information for campgrounds utilizing
the tab system, we will still collect your (the “Users”) name, campsite
number, phone number, email address, and dates of stay. This
information is used to coordinate and fulfill each request. We recommend
reviewing the campersAPP enabled Park’s terms and privacy policies
when utilizing the tab system to see how they use and store your payment
preferences.

Some campgrounds utilize campersAPP’s third-party payment processor
(STRIPE) to process payments in App. If a campground uses Stripe to
process in app services, you will be prompted to enter financial data. This
information is not stored by campersAPP or the campground you are
visiting. To learn more about how your financial data is used and stored,
visit Stripe’s website to view the TOS and privacy policy. If you wish to
have your campersAPP account deleted, please email
support@campersapp.com.
Account Security
You (the “Users”) are responsible for maintaining the confidentiality of your
account, including securing your campground issued login Key. The login Key is
associated with your name, campsite number, phone number, and payment
preferences. If you are traveling with family members, and grant them
permission to log into your account, you are fully responsible for any fees that
may incur should items be purchased using your login Key. In addition, you
agree to notify campersAPP immediately if you suspect unauthorized use of your
account.
Notifications
campersAPP may deliver notifications to your phone or to a mobile device.
Campground utilizing the service may send notifications for Alerts, Games,
Activities or general reminders. You (the “User”) can disable notifications within
the “App Settings” area of the mobile device or you if you wish to turn off only
some notifications (by type), you can do so within the account settings area of
the campersAPP mobile app.
Cookies and Use of Cookie Data
When you utilize the campersAPP Service, we may use cookies to facilitate
access to our Service and also to personalize your experience using the service.
We may collect information about your activity such as the pages you are visiting,
the time and dates and the links you click on. We may share cookie data with
campground owners and third parties.
Interactions with Other Campers
You are solely responsible for your interactions with other campers during the
time of your stay. campersAPP is not responsible for the conduct of any camper
(User) and shall not be liable for any losses or injuries that may arise, whether
intentional or incidental, relating to (but not limited to) meet-ups, activities or
communications with other camp goers.
With whom do we share your information
If you are a campground registered on the campersAPP network, none of your
personal information will be shared with any third parties. If you are a camper,
guest or “User” of the campersAPP mobile App, and register an individual
account, your information will be shared with the campgrounds you are visiting
for the purpose of enhancing your experience. Non-personal data which may
include your device ID and clicks within the App may be shared with third party
advertisers.
Content
By posting Content as part of the Service, you automatically grant campersAPP
non-exclusive, transferable, worldwide rights and license to use, copy, store,
play, modify and distribute the content.
campersAPP is not obligated to monitor or review the Content provided by
campgrounds however if the Company learns of violations or finds content that is
deemed harmful in any way to others, the Company reserves the right to delete
the content and ban the person(s) in violation.
Prohibited content is content that:
- Promotes racism, hatred or harm of any kind
- Is deemed harassment or intimidation
- Is intended to defraud others
- Includes unsolicited transmission of “junk” mail including trolling, phishing, alike.
- Promotes illegal activities or conduct
- Promotes unauthorized sharing of another person’s photo, video or audio
without his or her permission
- Infringes on campersAPP copyright/trademark
- Provides information about illegal activities such as buying illegal drugs
and weapons
- Contains viruses and disruptive codes
- Disrupts the function and flow of the app, leading to a negative experience
for others
- Solicits personal information for unlawful reasons
- Publicizes non-camp related commercial activities
Proprietary Rights
campersAPP owns and retains all proprietary rights for the Service and all the
content including but not limited to trademarks, videos, text, designs, graphics,
images, APIs, logos, software, content of others and computer code). Without
campersAPP’s expressed written consent, the APP and Site cannot be used for
commercial endeavors such as advertising and soliciting. You further agree to
not modify or create derivative works from the copyrighted material, trademarks,
or any other intellectual property. The Company will investigate and take legal
action in response to any illegal or unauthorized use of the Service.
Privacy Statement
To enable us to provide you (the User) with an interactive personalized
experience, campersAPP will need to collect information from you through our
Site/App that will be used to enhance your experience. We will not share your
personal information with third parties. We may share non-personal data about
your use on the App including the links you click in App with third-party
advertisers.
Disclaimers
Any material used or obtained through the use of the campersAPP mobile App,
campersAPP website and campground app interface is accessed at your own
risk. You waive any and all claims and causes of action regarding damage to
your mobile phones, tablets and computers.
campersAPP may at any time present offers by third parties including and not
limited to advertisements and promotions. All content provided by third parties is
their responsibility. campersAPP does not endorse and is not liable for content
provided by third party sources.
By using campersAPP (the Service) you agree to give up your right to go to
court, participate in court claims or other class proceeding.
Your use of the campersAPP is at your sole risk. The service is provided on an "as is" and "as available" basis without any warranty or condition, express, implied or statutory.
campersAPP does not warrant that the service will be uninterrupted, timely, secure, or error-free.
campersAPP reserves the right to modify, suspend or terminate the service with any participating campground for any reason, without notice, at any time. Furthermore, violation of any of the terms specified in the Terms of Service will result in the termination of your account.
campersAPP reserves the right to refuse service to anyone, for any reason, at any time.
